                Introduction

Professional indemnity (PI) insurance is an essential component of safe and ethical practice for behaviour analysts. It provides protection for both practitioners and the clients they serve in the event of claims arising from professional advice, services, or errors in practice.

Holding adequate PI insurance is not just a formality—it is a professional responsibility that aligns with the National Code of Conduct for Health Care Workers, which applies to all health care workers who are not registered under the Health Practitioner Regulation National Law Act 2009.

The NASRHP Standards (Standard 9) emphasise that certifying entities must provide practitioners with general guidance about PI insurance, and encourage annual review and retention of run-off insurance for practitioners no longer actively practising.

                Who needs professional indemnity insurance?

All practising behaviour analysts are expected to hold PI insurance, including:

                • Practitioners employed by organisations
                • Self-employed or private practitioners
                • Practitioners working on a casual or part-time basis

Even if you are taking a break from active practice or transitioning to retirement, it is recommended that you consider run-off insurance to cover claims that may arise after your practice ends. Students and non-practising members are exempt from this requirement.

                Why professional indemnity insurance matters

PI insurance provides coverage for civil liability claims that may arise as a result of:

                • Negligent acts, errors, or omissions in professional practice
                • Advice or services provided to clients
                • Legal costs associated with defending claims

If a client or stakeholder alleges that your professional advice or services caused harm or loss, PI insurance helps ensure that both you and your clients are protected.

                Your responsibilities as a practitioner

ABA Australia encourages all behaviour analysts to:

                1. Maintain current coverage appropriate to your scope of practice.
                2. Review your insurance annually to ensure it reflects your current work, including new services, settings, or client populations.
                3. Consider run-off insurance if you retire or cease practising, as claims can arise years after services have been provided.
                4. Keep records of your insurer name, policy number, coverage limits, and expiry date.
When submitting applications or renewals with ABA Australia, you will be asked to declare that you hold professional indemnity insurance adequate for your practice.

                Getting the right coverage

Selecting adequate PI insurance may require discussion with your insurer or a legal professional. Important considerations include:

                • Coverage limits appropriate for the risks associated with your practice
                • Scope of coverage, including advice, consultation, and direct services
                • Whether your insurance extends to all practice settings and client populations you work with

ABA Australia does not provide insurance but can guide you to reputable providers and resources.

                Summary

Professional indemnity insurance is a cornerstone of professional practice. By maintaining appropriate insurance, reviewing it annually, and considering run-off coverage, you protect yourself, your clients, and your professional reputation.
